Terms of service

The school owns its records and decides who sees them; we run the service that keeps them. A new school gets a 30-day free trial. An unpaid school keeps read access after a 7-day grace period but cannot make changes until it pays, and nothing is deleted for late payment. A school that leaves is deleted for good 90 days later unless it returns.
1. The agreement
These terms are an agreement between Skulink Kenya (“we”) and the school that registers for Skulink Kenya (“the school”), and they also apply to everybody the school gives an account to — staff, parents and guardians.
The person who registers a school confirms that they are authorised to accept these terms on its behalf. Using Skulink Kenya means accepting them and the privacy policy.
2. The service
Skulink Kenya is an online school management system: learner records, marks, grading and report cards, CBC assessment, fees, attendance, timetables, teaching records, messaging and SMS, and the other modules the school chooses to use. We may improve and change features over time; we will not remove a feature a school relies on without telling it first.
3. The school's responsibilities
- Its records. The school owns the information it enters and is responsible for its accuracy and for having the right to record it — including the consent of parents or guardians for their children’s information, as the Data Protection Act, 2019 requires.
- Its people. The school decides who gets an account and what each person may do, and removes access when somebody leaves.
- Its messages. The school is responsible for what it sends to parents and staff, including by SMS, and for sending only to people it has a genuine reason to contact.
- Its decisions. Grades, rankings and fee balances are calculated from what the school enters and the settings it chooses. The school checks them before relying on them or publishing them.
4. Accounts and security
- Each account is for one person. Keep your password and sign-in codes to yourself; we will never ask you for them.
- Tell the school, or us through the Help button, straight away if you think somebody else has used your account.
- Parents see only their own children, and staff only what their role and duties allow.
5. Acceptable use
Nobody may use Skulink Kenya to:
- look at or try to reach information their account is not meant to see;
- send unsolicited, misleading or abusive messages;
- upload anything unlawful, or anything that infringes somebody else’s rights;
- interfere with the service, test its security without our written permission, or copy it.
We may suspend an account that does, and will tell the school why.
6. Trial, subscription and payment
A new school gets a free trial of 30 days with every feature included. After that, the school pays the subscription for the plan it chooses, at the price shown when it subscribes, for the period it pays for.
If a subscription is not renewed by its end date, the school has a further 7 days of grace. After that its records can still be read, but not changed, and SMS stops, until it is paid for. Nothing is deleted because a payment is late.
SMS is charged from the school’s SMS allowance, one unit per message per recipient. Prices may change; a change applies from the school’s next renewal, and we will tell the school before then.
7. The school's data
The school’s information belongs to the school. We process it only to provide the service, as described in the privacy policy, and we do not sell it or use it for advertising.
The school can export its records at any time. If the school leaves, its account is archived and everything it holds is deleted permanently 90 days later, unless it returns before then.
8. Availability
We work to keep Skulink Kenya available and its records safe, but it depends on the internet, mobile networks and our service providers, and there will be occasional interruptions and maintenance. SMS delivery depends on the mobile networks and cannot be guaranteed. We will tell schools in advance of planned maintenance where we can.
9. Liability
We provide Skulink Kenya with reasonable care and skill. To the extent the law allows, we are not liable for indirect or consequential loss, or for loss caused by information the school entered or decisions made from it, and our total liability to a school in any year is limited to what the school paid us in that year.
Nothing in these terms limits any right that cannot be limited under Kenyan law, including under the Consumer Protection Act, 2012.
10. Ending the agreement
A school may stop using Skulink Kenya at any time; a subscription already paid for is not refunded for the unused period unless we have failed to provide the service. We may end the agreement if a school seriously breaches these terms and does not put it right after being told. In either case the school’s records are handled as described above.
11. Law and disputes
These terms are governed by the laws of Kenya. We will first try to settle any dispute by talking; if that fails, the courts of Kenya decide.
We may update these terms; the date at the top shows the latest version, and we will tell schools of an important change before it takes effect.
